## Clear Role Requirements: An Importer's Secret Weapon in FSVP Compliance

The FDA's [Foreign Supplier Verification Programs](https://www.fda.gov/food/food-safety-modernization-act-fsma/fsma-final-rule-foreign-supplier-verification-programs-fsvp-importers-food-humans-and-animals) (FSVP) regulations are designed to ensure that the food imported into the U.S. meets applicable food safety standards. Under the rule, importers are responsible for evaluating and approving their suppliers, verifying that suppliers properly control identified risks, and documenting their verification efforts and decision-making.

But the import process is complex, with overlapping roles inside and outside your organization affecting how products enter the U.S. Without clear ownership, essential activities may be missed, justification may go undocumented, and records may be difficult to retrieve upon FDA request.

Clearly defined roles — both in the import process and within your organization — are essential to navigating this complexity while mitigating supplier risks, meeting FSVP requirements, and maintaining food safety.

What is an FSVP Importer?

The FDA defines an FSVP Importer as the U.S. owner or consignee of a food offered for import into the United States (or a designated U.S. agent, with written consent). This entity is responsible for:

- Conducting or reviewing a hazard analysis for each supplier and each type of applicable imported food
- Evaluating, approving, and verifying suppliers
- Documenting these activities
- Maintaining FSVP records

If your organization [qualifies as an FSVP Importer](https://www.fda.gov/media/94281/download?attachment), it must designate one or more Qualified Individuals (QIs) to develop and maintain the FSVP and perform all related activities.

### FSVP Stakeholders: Related Roles & Responsibilities

Determining whether your business qualifies as an FSVP Importer is half the battle, as one of the first things the FDA evaluates during an inspection is whether your organization clearly understands and can identify this role. The import process requires the cooperation of several stakeholders, and some of these entities may overlap in their responsibilities. However, these roles are not interchangeable.

Understanding each role and its responsibilities — and, more importantly, who owns responsibility for developing the FSVP, maintaining records, and supervising verification efforts — is essential. Not only does this prevent required activities from falling through the cracks, but it also ensures documentation is consistent and accurate.

Explore some important stakeholders under FSVP:

- Qualified Individual: Rather than the entity responsible for FSVP compliance, this term refers to the individual(s) executing FSVP-related tasks for an importer — such as hazard analyses and supplier verification. These individuals must have education, training, or relevant experience related to their specific FSVP responsibilities and understand the records involved.
- Importer of Record: A designation established by U.S. Customs and Border Protection (CBP), the importer of record is not necessarily connected to the FDA. Organizations may qualify as both the importer of record and the FSVP Importer for a shipment, but one designation does not automatically establish the other.
- U.S. Agent: In some cases, this role can qualify as the FSVP Importer, but only if there is no U.S. owner or consignee of goods at the time of U.S. entry. This representative of the foreign supplier must provide written consent accepting the responsibility of being designated FSVP Importer; without this documentation, the FDA may not accept the importer relationship as valid.
- Broker: This role commonly manages customs and importing logistics. In some cases, brokers may meet the criteria of FSVP Importer and/or perform verification activities if appropriately qualified.

Ultimately, the organization listed as the FSVP Importer at U.S. entry should clearly correspond with the organization responsible for FSVP activities and decisions.

But beyond external roles, your internal team must also have clearly defined responsibilities and ownership to ensure effective FSVP activities. Your Qualified Individuals are the driving force behind your FSVP.

## How to Define Roles Internally to Ensure FSVP Preparedness

A strong FSVP should clearly show identified risks, how foreign suppliers were evaluated, and why their selected controls and verification activities are appropriate. This is required not only for every applicable foreign supplier, but also for each food or product type from each supplier. Depending on the size of your operation, the products and ingredients you import, and the number of foreign suppliers you import from, the performance and supervision of these activities can quickly snowball.

For your QIs to perform effectively, they must understand what they are responsible for. Assigning clear ownership for FSVP Importer tasks, whether your qualified individual(s) are a part of your internal team or outsourced, allows you to:

- Avoid documentation gaps.
- Ensure completed hazard analysis and supplier verification.
- Encourage proactive FSVP efforts.
- Reduce confusion.

Clearly outlined roles and responsibilities allow your QIs to perform and document their identified duties. Just remember that internal responsibility and regulatory responsibility are not the same; the FSVP Importer is ultimately responsible for developing and maintaining the FSVP. But assigning ownership of specific activities to QIs can help ensure that those activities are completed.

![Pull quote graphic emphasizing that while FSVP activities may be assigned internally, the FSVP Importer remains ultimately responsible for developing and maintaining the Foreign Supplier Verification Program.](https://blog.aibinternational.com/hs-fs/hubfs/Blog%20Post%20Pictures/In-Blog%20Images/aib-international-fsvp-importer-responsibility-fsvp-compliance-pull-quote.png?width=1080&height=400&name=aib-international-fsvp-importer-responsibility-fsvp-compliance-pull-quote.png)

### 1. Identify one or more qualified individuals

The FDA expects that the individuals performing food safety activities within your FSVP have the appropriate knowledge, education, training, or experience to do so competently. Whether these QIs are performing hazard analyses, conducting supplier evaluations, or reviewing verification activities, the FDA expects FSVP Importers to be able to document and justify that those individuals have the expertise to perform those duties.

If you don't have any internal team members with relevant experience or education, you may train one or more individuals in the FSVP requirements they would be responsible for or even [work with a third-party expert](https://aibinternational.com/products/assign-an-expert) to execute related duties.

A single QI may be sufficient for a limited operation, but relying on one person can create workload, continuity, and backup risks. Larger operations may find it difficult for a single employee to manage the scope of work necessary to meet FSVP requirements when importing multiple products from multiple suppliers.

### 2. Assign and document ownership for FSVP activities

Once you've identified your qualified individual(s), you must assign them core FSVP activities. These duties may be delegated based on the background and experience of certain individuals in key FSVP areas, such as:

- Hazard analysis
- Risk and performance evaluation
- Product testing
- Supplier audits
- Document review
- Corrective actions

Again, individuals must be qualified to perform their specific responsibility. This qualification should be assessed activity by activity. A person experienced in document management may not necessarily be qualified to conduct a hazard analysis, while an experienced food safety professional may still require training on your organization’s record-retrieval procedures. For each activity, it’s important to document who performs the work, who reviews and approves it, who maintains relevant records, and who serves as backup.

### 3. Train team members on their respective duties

Once your team knows what they need to do, they must then know how to do it. One way to bring your team up to speed is to partner with experts in the field. By working with a third-party training partner that has experience in FSVP, you can equip your QIs with the tools they need to meet compliance requirements, protect consumers, and stay ahead of FDA requests.

Providing a foundational education on FSVP responsibilities for your entire team is an excellent starting point. However, if you are assigning duties to multiple QIs, providing role-specific training can also be critical to their success. Qualified individuals should understand how to perform their duties competently and consistently — which may require more in-depth training in a specific area.

As you implement your training, make sure to document and verify not only the completion of this education — but also that your team can competently perform their duties in the real world.

## Building a Team of FSVP Experts

Identifying and communicating ownership of responsibilities is paramount to FSVP success. But knowing how to perform those responsibilities effectively is equally important for meeting FDA expectations and, ultimately, keeping U.S. consumers safe.
